Terms and Conditions of Hire – Limousines & Chauffeured Vehicles

(Applicable in Victoria, Australia)

These Terms and Conditions apply to all limousine and chauffeured vehicle services supplied by the Company (Wheels Of Fortune Limousines) to the Hirer. By paying a deposit, signing a Booking Confirmation, or otherwise proceeding with a booking, the Hirer acknowledges and agrees to all terms outlined in this document.

The Hirer accepts full responsibility for themselves and every passenger in their party and warrants they are authorised to agree to these terms on behalf of all passengers.

  1. Definitions

For the purposes of this agreement:

  • Company – the limousine and chauffeured vehicle operator providing the hire services.
  • Hirer – the individual or business making the booking, or any representative acting on their behalf.
  • Vehicle – the limousine or chauffeured vehicle provided for the Hire Period.
  • Hire Period – the time the Vehicle is booked for, including any extensions.
  • Booking Confirmation – the written confirmation issued by the Company specifying booking details.
  • Booking Cost – the total cost payable for the Hire Period.
  • Booking Cost Deposit / Deposit – the non-refundable deposit payable at the time of booking.
  • Additional Stock – any non-alcoholic consumables requested by the Hirer.
  • Chauffeur – the licensed driver assigned to operate the Vehicle.
  1. Booking, Deposit & Payment Terms
  1. A non-refundable deposit (minimum $200 or 50% as stated on the Booking Confirmation) is required at the time of booking.
  2. Payment of the deposit constitutes acceptance of these Terms & Conditions.
  3. The Hirer must supply a valid credit card as security for damage, additional cleaning, overtime, or losses incurred by the Company.
  4. Government-issued identification may be requested to verify credit card ownership.
  5. The remaining balance is due no later than 2 business days prior to the Hire Period.
  6. The Company is authorised to charge the Hirer’s credit card for:
    • outstanding balances
    • overtime
    • cleaning or sanitation fees
    • damage repairs
    • additional stock
    • unpaid fees described within this document
  7. No refund will be made if the Hire Period ends earlier than the time booked.
  1. Cancellations

The following cancellation rules apply:

  • More than 4 weeks prior: Deposit is forfeited.
  • Less than 4 weeks prior: 50% of the total Booking Cost is payable.
  • Less than 7 days prior: 100% of the Booking Cost is payable.
  • All deposits and prior payments are strictly non-refundable.

Cancellations must be made in writing.

  1. Amendments to Bookings
  1. Any changes to time, date, location, or Vehicle are subject to availability and at the Company’s sole discretion.
  2. A booking amendment fee may apply.
  3. If the Hirer requests additional time during the Hire Period:
    • extensions are only permitted when no other bookings prevent continuation
    • overtime is charged in 15-minute increments based on the rate in the Booking Confirmation
    • overtime must be paid in cash to the Chauffeur or may be charged to the stored credit card.
  1. Vehicle Substitution & Unforeseen Circumstances
  1. The Company may substitute a Vehicle if the booked Vehicle becomes unavailable due to mechanical, electrical, safety or operational issues.
  2. The Company will make reasonable efforts to notify the Hirer and provide:
    • an equivalent vehicle, or
    • a suitable alternative
  3. If no alternative can be provided, the Hirer is entitled to a refund only for the portion of the booking cost related to the unavailable vehicle.
  4. The Company is not liable for:
    • consequential loss
    • missed events
    • inconvenience due to breakdowns, traffic, roadworks, or delays beyond the Company’s control.
  1. Conduct, Safety & Legal Requirements
  1. All passengers must comply with Victorian road laws, including mandatory seatbelt use.
  2. Only the Chauffeur may open/close doors unless in an emergency.
  3. The Company may immediately terminate the hire (without refund) if any passenger engages in:
    • aggressive, abusive or unsafe behaviour
    • illegal activity
    • leaning out of windows, standing through sunroofs, sitting on the exterior
    • misuse of fixtures, equipment or vehicle property
    • intoxication deemed unsafe by the Chauffeur
  4. The Vehicle cannot exceed its legal seating capacity.
  5. Smoking, vaping, and e-cigarette use are strictly prohibited. If breached:
    • immediate termination of hire
    • cleaning/damage fee charged to Hirer’s credit card
  6. Child seats must be supplied and installed by the Hirer at their own risk. The Company does not provide or fit child restraints.
  7. Alcohol consumption is prohibited for under-18 events (school formals, debutante balls, children’s parties).
  1. Food, Drinks & Additional Stock
  1. Food is not permitted unless approved in writing by the Company prior to the Hire Period.
  2. Alcohol requests cannot be fulfilled by the Company; BYO rules apply in accordance with Victorian law.
  3. Requests for Additional Stock must be made at least 7 days prior and will be charged at cost + 15% service fee.
  1. Damage, Cleaning & Sanitation Fees

The Hirer is fully liable for all damage or loss, including that caused by any member of their party or third parties incited by their behaviour.

The Company may charge the following without notice:

  • Sanitation fee for vomiting: from $350–$395
  • Excessive cleaning fee: amount determined by level of cleaning required
  • Damage repair costs: full cost of parts, labour, and associated losses
  • Loss-of-use compensation: if the Vehicle becomes unavailable for subsequent bookings due to damage or cleaning caused by the Hirer

All property including glassware, lighting, entertainment systems, bar equipment and accessories remain the Company’s property.

  1. Access, Routes & Venue Limitations
  1. Stretch limousines have restricted access. The Chauffeur may refuse entry to:
    • certain driveways
    • underpasses or carparks
    • unsafe or illegal stopping zones
  2. The Company is not liable for delays caused by restricted access.
  3. Routes are chosen at the Chauffeur’s discretion based on safety, traffic and road conditions, unless specified and agreed in writing.
  1. Lost or Forgotten Items
  1. The Company is not liable for any personal belongings left in the Vehicle.
  2. Items found will be held for 3 months and may be collected or returned at the Hirer’s expense.
  3. The Company makes no guarantee that lost property will be recovered.
  1. Privacy

The Company collects personal information solely for booking and service purposes, in accordance with the Privacy Act 1988 (Cth).
Personal information will not be disclosed without consent unless required by law.

  1. Indemnity & Limitation of Liability

To the maximum extent permitted under Victorian law:

  1. The Hirer indemnifies the Company, its staff, officers, and subcontractors against all claims, losses, damages, fines, liabilities, and costs arising from:
    • any action or negligence by the Hirer or their party
    • breach of these terms
    • damage to the Vehicle or property
    • unsafe or unlawful behaviour
  2. The Company is not liable for:
    • indirect or consequential loss
    • missed flights, events, or functions
    • delays caused by traffic, weather, road closures, or enforcement actions
  3. Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded.
  1. Business & Corporate Bookings

Where a booking is made on behalf of a business or organisation, that entity assumes full Hirer liability.
The representative making the booking warrants they have authority to bind the organisation to these Terms.

  1. Variations

The Company reserves the right to update these Terms & Conditions at any time.
The version in force at the time of booking will apply unless changes are required by law.

  1. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.
All parties submit to the non-exclusive jurisdiction of Victorian courts and tribunals.
